Although their bet Risa Hontiveros occupies the 13th slot in the senatorial race based on the latest results released by the Commission on Elections, the Liberal Party (LP) will not ask that 13 senators be elected.

“What is clear is that we are electing 12 senators,” said LP campaign manager Butch Abad, adding that to elect 13 would be to “stretch the law.”

Abad said their party is respecting Comelec’s authority on the issue but admitted that the election of Hontiveros would be “favorable” to their party.

Experts have recently disagreed on whether or not the seat of Sen. Benigno “Noynoy” Aquino III, who latest results project as landslide winner of the presidential contest, should be given to the candidate who ranked 13th in the senatorial lineup.

In a radio interview with dzBB, newly reelected senators Miriam Defensor-Santiago and Juan Ponce Enrile had different takes on the issue.

Santiago cited the precedent case wherein 13 senators were proclaimed in 2001 to fill the seat vacated by former Sen. Teofisto Guingona, Jr. when President Gloria Macapagal-Arroyo appointed him vice president.

Santiago added that the House of Representatives may pass a law allowing the election of the 13th senator.
